Freedom of Information Notice

You may request access to any record held by the College of Health and Care Professionals of British Columbia (CHCPBC). We will respond to your request in accordance with the Freedom of Information and Protection of Privacy Act (FOIPPA).

Are any records available without request?

We make some records available without request, including the following:

Applicants and licensees can also access some record types via the Licensee Portal.

How can you access records not available via the above links?

You can submit a freedom of information (FOI) request to the CHCPBC Privacy Office by emailing us at foi@chcpbc.org.

Your request must provide your full contact information and must provide sufficient detail to allow a CHCPBC staff member to identify the records you are seeking.

If you are seeking access to your own personal information, refer to the Privacy Notice.

Exceptions to what CHCPBC can disclose

In most cases, you will receive the record(s) you requested. Please note that according to applicable law, the College is unable to disclose certain types of information.

The exceptions to disclosure are listed in sections 12 to 22 of FOIPPA.

Is there a fee for accessing records?

For general FOI requests, a $10 non-refundable application fee is required. Your request will not be processed until payment is received. Please send a personal cheque or money order from a Canadian bank, payable to “College of Health and Care Professionals of British Columbia,” to “CHCPBC Privacy and FOI Office” at the address listed below. Include your file number (if available).

Processing fees may also apply where applicable. Processing fees may apply to general FOI requests, depending on the size and complexity of the request. Section 75 of FOIPPA outlines the processing fees that can be charged for non-personal FOI requests for the following tasks or services:

  • locating, retrieving and producing the record;
  • preparing the record for disclosure;
  • shipping and handling the record;
  • providing a copy of the record.

There are no processing fees charged for:

  • the first three hours spent locating and retrieving a record; or
  • time spent severing (removing) information from a record.

What can you expect after submitting a request?

CHCPBC will respond to you within 30 days (excluding weekends and statutory holidays) of receiving the request. We may extend the timeline for responding to your request if FOIPPA allows us to do so. If we extend the timeline, we will send you a letter of extension before the end of the initial 30-day period to inform you of the reason for the extension. We may be allowed or required to withhold some requested records, or some information within records. If we withhold records or information, in our response we will tell you which section of FOIPPA allows or requires us to do so.

How can you raise FOI questions, concerns, or complaints?

You can send FOI-related questions, concerns, or complaints to the CHCPBC Privacy Office. The CHCPBC Privacy Office will acknowledge your question, concern, or complaint and will tell you what to expect next.

You may apply to have processing fees waived if you have valid grounds, as outlined on the BC Government’s Fees for Freedom of Information Requests page. Please include details of your request for processing fees to be waived as part of your FOI request and/or contact the CHCPBC Privacy and FOI Office directly.

If we cannot resolve your concern or complaint, you can contact the Office of the Information & Privacy Commissioner for British Columbia (OIPC). See the OIPC website for more information.
